Terms of Service

1Who we are

Influencer Gift Form is built and run by Magnuson Ventures LLC, a California limited liability company ("we", "us"). "You" means the business that installs the app on its Shopify store, and the people it lets use the app.

2The service

The app lets you send influencers a gift form or a one-time gift link. When an influencer fills it in, the app creates the order in your Shopify store. It can also keep a record of the influencers you gift, track shipping and delivery, and find the social posts they make about you.

3Your account

• Your account is your Shopify store. You must have the right to install apps on it.
• You are responsible for the people you give access to, including team members, API keys and connected AI assistants.
• Keep API keys secret. Tell us right away if you think one has leaked, and revoke it in Settings, then Developer.

4Plans and billing

Plans and prices are shown in the app and on the Shopify App Store. All charges are billed by Shopify on your Shopify invoice, under Shopify's terms. Changing or canceling your plan happens in the app or by uninstalling it. Unless the law requires otherwise, charges already billed are not refunded.

Gift orders are $0 orders in your store. You pay for the products you give away and for shipping them. We never charge influencers.

5Your responsibilities

• Only send gift forms and links to people you are allowed to contact, and follow the laws that apply to your marketing, including disclosure rules for gifted or sponsored posts.
• Don't use the app for anything illegal, harmful or deceptive, to send spam, or to gift restricted products where that isn't allowed.
• Don't try to break, overload or get around the security of the app, or read data that isn't yours.
• You are responsible for the products, orders and shipments in your store, including taxes and customs.

6AI connector (Claude, ChatGPT and other assistants)

You can connect an AI assistant to one of your stores. Once connected, it can make gift links, cancel unused ones, and read your gift orders, forms and influencer records for that store.

• The assistant acts on your instructions. Check what it does, especially links it makes and cancels. You are responsible for the actions it takes through your connection.
• We don't send emails or messages to influencers for you. You decide how and whether to send the links.
• The assistant is made by another company (such as Anthropic or OpenAI), under that company's own terms and privacy policy.
• You can disconnect at any time in the app under Settings, then Developer.

What data the connector receives is described in our privacy policy.

7Your data

Your store data and the influencer data you collect stay yours. We use it only to run the service for you, as described in our privacy policy. You give us permission to process it for that purpose. You are responsible for having the right to collect the influencer data you ask for on your forms.

8Availability and changes to the app

We work to keep the app running and your orders flowing, but we can't promise it will never be down or error free. We may add, change or remove features. If we remove something important you rely on, we'll tell you ahead of time when we reasonably can.

9Disclaimers

The app is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise any marketing result from gifting, such as posts, sales or reach.

10Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim about the app is limited to the amount you paid us for the app in the 12 months before the claim.

11Ending the service

You can stop at any time by uninstalling the app. We may suspend or end your access if you break these terms or use the app in a way that harms others or the service. After you uninstall, we handle your data as described in our privacy policy.

12Changes to these terms

We may update these terms. We'll post the new version here with a new date, and tell you in the app or by email if a change is important. Using the app after a change means you accept it.

13Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of law rules.
